Consent to Personalized Advertising

In accordance with the Federal Law of July 27, 2006 No. 152-FZ “On Personal Data”, having read the Privacy Policy and the Personal Data Processing Rules of RandomSet.RU, I, the data subject, hereinafter referred to as the “User”, freely, of my own free will and in my own interest, hereby give specific, substantive, informed, conscious and unambiguous consent to the processing of personal data to personalize advertising under the following conditions.

1. Personal Data Operator

1.1. This Consent is given to Pavel Andreevich Kiselev (hereinafter referred to as the Operator), an individual applying the special tax regime “Professional Income Tax” (self-employed), address: 117403, Russian Federation, Moscow, Biryulyovo Zapadnoye Municipal District, 3 Kharkovskaya St., Bldg. 8, Apt. 108, email: info@1294studio.ru.

2. List of data

2.1. This Consent applies to the use of the following data for the purpose of personalizing advertising:

device advertising identifier and other technical identifiers used by the embedded advertising software component of YANDEX LLC (hereinafter referred to as the SDK) for personalization;
information about the device, operating system, version of the Application and network connection to the extent they are used to personalize advertising;
information about ad impressions, click-throughs and other interactions to the extent that they are used for personalization and measurement of its effectiveness;
advertising personalization mode selected by the User.

2.2. The processing of certain technical data for displaying non-personalized advertising, ensuring security, preventing fraud and accounting for impressions is carried out on the grounds specified in section 6 of the Personal Data Processing Rules and does not depend on the provision of this Consent.

2.3. This Consent does not apply to the processing of the unique installation identifier (hereinafter referred to as UUID) and other data for the purpose of providing the Application, diagnostic and security functions. The composition, purposes and grounds for such processing are defined in Section 6 of the Personal Data Processing Rules.

2.4. The Application does not request geolocation. Device coordinates are not included in this Consent and are not intentionally transmitted through the advertising software component.

2.5. Random selection results are not sent to the server and are not used for advertising, analytics or profiling.

3. Purposes of processing

3.1. The data specified in clause 2.1 is processed for:

selection and display of personalized advertising;
evaluation of the effectiveness of advertising personalization.

4. Actions and processing methods

4.1. Processing is performed automatically using the Application, the User’s device and the Internet, together with the Yandex Mobile Ads SDK, an embedded component provided by YANDEX LLC to load and display advertising and record interactions with it.

4.2. Processing may include collection, recording, organization, accumulation, storage, updating, retrieval, use, provision to designated persons, blocking, deletion and destruction.

4.3. Data are not disclosed to the general public on the basis of this Consent.

5. Data recipients

5.1. Data processed on the basis of this Consent may be provided to YANDEX LLC, 119021, Russia, Moscow, 16 Lev Tolstoy St., and participants of the advertising infrastructure to the extent necessary to personalize advertising and evaluate the effectiveness of personalization.

5.2. The coordinates of the User’s device are not transmitted to YANDEX LLC and advertising infrastructure participants via the advertising SDK.

5.3. Further processing of data received by the advertising SDK directly from the device is carried out by the relevant participants in the advertising infrastructure in accordance with the documents and legal bases applicable to them.

6. Providing Consent

6.1. Consent is given through a separate affirmative action in the Application interface and is not considered given merely by accepting the User Agreement or starting to use the Application.

6.2. Failure to provide Consent does not limit access to the functions of the Application. In this case, the User is shown non-personalized advertising, for delivery of which the advertising SDK may process a minimum set of technical data on the grounds specified in section 6 of the Personal Data Processing Rules.

6.3. Consent is given by a User aged 18 or older.

7. Validity period

7.1. Consent is valid from the moment it is provided until the User changes the advertising mode to non-personalized or until the corresponding processing is terminated for other reasons.

7.2. Information confirming the fact of granting or revocation of Consent may be stored for up to three years after revocation or the last event related to the use of Consent, to confirm compliance with legal requirements and protect the rights of the Operator.

8. Withdrawal of Consent

8.1. The User has the right to revoke Consent at any time by changing the advertising mode to non-personalized in the settings section of the Application. Withdrawal takes effect when the settings are saved and the selected mode is transferred to the advertising SDK.

8.2. After revocation, further use of the data for ad personalization will cease. The User may continue to be shown non-personalized advertising with the processing of minimal technical data on the grounds specified in section 6 of the Personal Data Processing Rules.

8.3. Deleting the Application stops future data transfers from the corresponding device. The processing of data received by participants in the advertising infrastructure before deleting the Application is carried out in accordance with the policies, retention periods and legal grounds applicable to them.

9. Confirmation of Consent

9.1. The Operator records the unique installation identifier, the selected type of advertising, information about the acceptance of the User Agreement, Privacy Policy and Consent to the processing of personal data, the number of the accepted document revision, as well as the date and time the server received this information.

9.2. The specified information is used to record Consent and confirm compliance with legal requirements, and not to identify the User.

10. Final provisions

10.1. Revocation of Consent does not affect the legality of processing carried out prior to its revocation, and does not terminate data processing carried out by the Operator on other legal grounds to provide the functions of the Application, diagnostics, security and compliance with legal requirements.

10.2. Before providing Consent, the User is provided with the opportunity to review the Privacy Policy, Personal Data Processing Rules, purposes, list of data, recipients, validity period and procedure for revocation of Consent.
